In Minnesota, Good Samaritan laws are designed to encourage bystanders to assist individuals in emergencies by offering legal protection and, in certain situations, imposing a duty to act.

Duty to Assist

Under Minnesota Statutes § 604A.01, subdivision 1, any person present at the scene of an emergency who knows that another individual is exposed to or has suffered grave physical harm is required to provide reasonable assistance, provided they can do so without endangering themselves or others. Reasonable assistance may include actions such as calling 911. Failure to provide such assistance is classified as a petty misdemeanor.

Subdivision 2 of the same statute grants immunity from civil liability to individuals who, without compensation or the expectation of compensation, render emergency care, advice, or assistance at the scene of an emergency or during transit to a location where professional medical care can be provided. This immunity applies unless the individual's actions are willful, wanton, or reckless. It's important to note that this protection does not extend to individuals rendering emergency care during the course of their regular employment and receiving compensation for their services.
